The ACLU of Pennsylvania has filed a lawsuit on behalf of a U.S. Air Force veteran to challenge policies in the county courts in Berks County that prohibit individuals from participating in treatment court programs as long as as they use medical marijuana to treat their serious medical conditions.

Philadelphia, PA - The U.S. Department of Justice has found that Pennsylvania’s state courts violated the Americans with Disabilities Act when its courts prohibited or limited access to medications for opioid use disorder.

The Pennsylvania Supreme Court ruled unanimously today that Lebanon County’s policy banning the use of medical marijuana by people who are on probation and who are registered medical marijuana patients violates state law.

Today, the Supreme Court of Pennsylvania heard arguments in a lawsuit challenging Lebanon County’s policy prohibiting the use of medical marijuana by people who are under community supervision, such as probation, and who are registered patients with the state Department of Health.
