Session: 2017-2018
ACLU-PA Position: Opposes

House Bill 2227 would permit Pennsylvania judges to issue extreme risk protection orders (ERPO) in order to “temporarily prohibit individuals who demonstrate an extreme risk of causing harm to themselves or others from possessing firearms or ammunition in addition to any other relief necessary.” Individuals subject to an ERPO are not alleged to have committed any crime. Rather, issuing an ERPO is based on speculation about a person's risk of possible violence, resulting in likely violations of privacy and due process rights.

*PLEASE NOTE: This bill was reintroduced in the 2019-2020 session as HB 1075. Significant changes were made to the new bill and as a result, the ACLU-PA changed its position from 'oppose' to 'neutral.' Please visit our bill page on HB 1075 for more information.
