HB 140 began as a benign bike lane bill until a Senate amendment added a provision that would allow a special prosecutor to be appointed in Philadelphia to investigate and initiate criminal proceedings for any violations occurring on SEPTA property (Southeastern Pennsylvania Transportation Authority). This was one of many politically motivated bills seeking to interfere with the prosecutorial discretion of the twice-elected Philadelphia district attorney.

Governor Wolf vetoed HB 140 on November 17, 2022 as Veto No. 12 of 2022.
