ACLU-PA Position: Opposes
SB 749 would weaken—and potentially even eviscerate—the protections provided by the Medical Marijuana Act to workers. The two most problematic provisions would:
- Allow employers to discriminate against people with medical marijuana cards who work in “safety-sensitive” positions (including child care and mining) even if there is no evidence that they are under the influence at work; and
- Allow employers to fire medical marijuana patients based solely on the employer’s perception that their use of medical marijuana adversely affects their job performance.
