ACLU-PA Position: Supports

HB 300 (PN 1135) would amend the Pennsylvania Human Relations Act (PHRA) to add explicit, statutory protections from discrimination based on sexual orientation and gender identity and expression. The PHRA currently protects people from discrimination based on race, color, religion, ancestry, age, sex, national origin, disability.

Today, any LGBTQ Pennsylvanian who faces discrimination in employment, housing, or public accommodation has recourse by filing a complaint with the Pennsylvania Human Relations Commission as a form of sex discrimination. Federal law also provides protection, thanks to a recent Supreme Court decision recognizing that sex discrimination includes sexual orientation and gender identity.

HB 300 is still critically necessary because it would ensure that protection from discrimination against LGBTQ people is enshrined in Pennsylvania law.
