Prisoners' Rights

Although the state is permitted to deny a person certain rights to liberty and property under criminal justice laws, prisoners retain their rights to other basic protections and freedoms - among these are freedom from cruel and unusual punishment, freedom of religion, the right to legal representation, and the right to due process.

The ACLU is involved in protecting prisoners' right by:

  • ensuring humane conditions within prisons and the adequate provision of medical and mental health care to prisoners
  • challenging the detention of immigrants without due process, regardless of how minor the immigrant's infraction was, how long ago it occurred, how long he or she has lived in the country, or whether a spouse or child is a U.S. citizen
  • protecting the right of prisoners to practice their religion while incarcerated
  • protesting sexual abuse and gender discrimination against female prisoners
  • advocating for adequate legal services for the indigent
  • supporting the restoration of a paroled prisoner's right to vote
